1. About Us
Welcome to The ADHD Adults Store, the official merchandise store associated with The ADHD Adults Podcast.
This website is operated by:
The ADHD Adults Ltd
Company registration number: 14953451
Registered in England and Wales
Email: theadhdadults@gmail.com
Throughout these Terms of Service, references to “we”, “us” and “our” mean The ADHD Adults Ltd.
References to “you” and “your” mean customers and visitors using our website.
Our online store is powered by Shopify, and our merchandise is manufactured and fulfilled by third-party print-on-demand suppliers.
The ADHD Adults Ltd remains the retailer responsible for your purchases.
2. Acceptance of These Terms
By placing an order through our website, you agree to these Terms of Service.
Please read them carefully before purchasing.
Your statutory consumer rights are not affected by these terms.
If any provision conflicts with applicable consumer protection legislation, the relevant statutory rights will take precedence.
3. Products and Merchandise
We sell clothing, accessories and other merchandise associated with The ADHD Adults Podcast.
Many of our products are manufactured using print-on-demand services.
This means products are generally produced after an order has been placed.
We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and specifications are accurate.
However, minor differences may occur between product images and finished merchandise because of screen settings, manufacturing processes and printing techniques.
Such differences do not affect your statutory rights where goods are faulty, materially different from their description or otherwise fail to meet applicable legal standards.
Product availability may change without notice.
4. Prices and Payment
All prices are displayed in the currency indicated on our website or at checkout.
For customers purchasing in GBP, displayed prices are in pounds sterling.
The ADHD Adults Ltd is not currently registered for UK VAT and does not charge UK VAT on its sales.
Product prices and delivery charges are displayed before you confirm your order.
We reserve the right to change prices at any time. Price changes will not affect orders already accepted.
Payment must be made using one of the payment methods available at checkout.
Payments are processed through Shopify Payments or other authorised payment providers.
We do not directly store your complete payment card details.
5. Placing an Order
When you place an order, you will receive an automated acknowledgement confirming that we have received it.
This acknowledgement does not necessarily mean that we have accepted your order.
A contract is formed when we send confirmation that your order has been accepted.
We may decline an order where there is a legitimate reason, including product unavailability, an obvious pricing error, suspected fraud or an inability to deliver to the specified destination.
If payment has already been taken for an order that we cannot accept, we will refund the amount paid without undue delay.
We will not make material changes to an accepted order without your agreement.
6. Print-on-Demand Manufacturing
Our merchandise is manufactured by third-party suppliers, including Printful.
Production normally begins after an order has been accepted and transmitted to our fulfilment partner.
Manufacturing and fulfilment times vary depending on the product, destination and supplier availability.
Orders containing multiple products may be manufactured or dispatched separately.
Although products are manufactured to order, this does not automatically remove your statutory cancellation rights.
Standard catalogue merchandise generally remains subject to the applicable cancellation provisions for distance contracts.
Genuinely personalised products may be treated differently, as explained in our Returns and Refunds Policy.
7. Shipping and Delivery
We offer delivery within the United Kingdom and to selected international destinations.
Available shipping methods, estimated delivery times and applicable charges are displayed at checkout where available.
Additional information is provided in our Shipping and Delivery Policy.
Unless we have agreed a different delivery period, we will deliver goods without undue delay and within 30 days of the contract being formed, in accordance with applicable UK consumer law.
We remain responsible for goods until they come into your physical possession, or that of a person you have identified to receive them, subject to the applicable statutory rules.
If goods are lost, damaged or delayed during delivery, please contact us.
Your statutory rights concerning delivery remain unaffected.
8. International Orders
International customers are responsible for ensuring that products can lawfully be imported into their destination country.
International orders may be subject to customs duties, import taxes or handling charges.
Where these charges are not included or prepaid at checkout, additional charges may become payable upon import.
We will provide information about applicable charges and responsibilities as required by law.
International customers may have additional mandatory consumer rights under the laws of their country of residence.
Nothing in these terms excludes rights that cannot lawfully be excluded.
9. Cancellations, Returns and Refunds
Customers purchasing standard merchandise online generally have the right to cancel their purchase within 14 days of receiving the goods, without providing a reason.
Customers must notify us of their decision to cancel within the applicable cancellation period.
Following cancellation, goods must generally be returned within a further 14 days.
Customers are responsible for the direct cost of change-of-mind returns where this has been communicated before purchase.
Refunds will be processed in accordance with applicable consumer law.
Further information is available in our Returns and Refunds Policy.
These cancellation rights do not limit your statutory remedies concerning faulty, damaged, incorrectly supplied or misdescribed goods.
10. Faulty or Incorrect Products
Under the Consumer Rights Act 2015, goods supplied to UK consumers must be:
- Of satisfactory quality.
- Fit for their intended purpose.
- As described.
If a product does not meet these requirements, you may be entitled to a repair, replacement, price reduction or refund, depending on the circumstances.
Please contact us if you experience a problem with your purchase.
We may request photographs or other information to help investigate the issue, but we will not impose unreasonable requirements that restrict your statutory rights.
Our suppliers’ commercial returns policies do not override our responsibilities as the retailer.
11. Product Sizing and Care
Customers should consult the sizing information provided with each product before ordering.
Sizing may vary between manufacturers and product styles.
We recommend following the care instructions supplied with each garment.
Normal wear and tear, accidental damage and damage caused by misuse are not generally manufacturing defects.
However, nothing in this section excludes your statutory rights where goods fail to meet the standards required by law.
12. Intellectual Property
Unless otherwise stated, the content of this website, including original artwork, merchandise designs, logos, branding, photographs and written material, belongs to The ADHD Adults Ltd or is used with appropriate permission.
These materials may be protected by copyright, trade mark and other intellectual property laws.
You may browse the website and purchase merchandise for personal use.
You must not reproduce, distribute, commercially exploit or use our protected designs or branding without permission, except where permitted by law.
Purchasing merchandise does not transfer ownership of any associated intellectual property rights.
13. Acceptable Website Use
You agree not to use our website for unlawful or fraudulent purposes.
You must not deliberately interfere with the website’s operation, attempt unauthorised access to its systems or misuse its functionality.
We may take reasonable action to protect the website, our customers and our business from unlawful or harmful activity.
14. Website Availability
We aim to keep our website accessible and functioning correctly.
However, we cannot guarantee uninterrupted availability.
Temporary interruptions may occur because of maintenance, technical problems or circumstances outside our reasonable control.
We will take reasonable steps to resolve problems affecting orders or customer services.
15. Privacy and Personal Information
We process personal information in accordance with our Privacy Policy and applicable data protection legislation.
Personal information may be shared with service providers where necessary to process payments, manufacture merchandise, fulfil orders and provide customer support.
Our Privacy Policy explains how personal information is collected, used, stored and protected.
Please review it for further information.
16. Third-Party Services
Our website uses third-party services, including Shopify and print-on-demand fulfilment providers.
These services support the operation of our store.
Where you purchase merchandise from us, your contract of sale is with The ADHD Adults Ltd, not with Shopify or our fulfilment suppliers.
We remain responsible for meeting our legal obligations as the retailer.
17. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of statutory consumer rights.
- Any other liability that cannot legally be excluded or restricted.
We are responsible for losses that are a foreseeable result of our breach of contract or failure to exercise reasonable care and skill, subject to applicable law.
We are not responsible for losses that are not reasonably foreseeable, except where the law provides otherwise.
These terms do not restrict any remedies available to consumers under applicable legislation.
18. Changes to These Terms
We may update these Terms of Service to reflect changes in our products, business operations, legal requirements or website functionality.
The latest version will be available on our website.
Changes will not retrospectively alter the terms of an existing purchase without your agreement, except where required by law.
19. Governing Law
These terms are governed by the laws of England and Wales.
If you are a consumer living in another part of the United Kingdom, you may also benefit from the mandatory protections available under the laws applicable to your place of residence.
If you live outside the United Kingdom, you may have additional mandatory consumer protections under the laws of your country.
Nothing in these terms prevents you from exercising rights or bringing proceedings in a court where applicable consumer protection law permits you to do so.
20. Complaints and Contact Information
If you have a question, complaint or concern about our merchandise or services, please contact us.
We aim to acknowledge customer enquiries within two working days and resolve complaints as promptly as reasonably possible.
